Terms of Use

These Terms of Use govern access to and use of the MALKOT website, platform, accounts, programs, community features, bookings and related services operated by Malkot Foundation, Palm Harbor, Florida, United States (“MALKOT,” “we,” “us,” or “our”).

These Terms have been approved by MALKOT management and are effective as of October 26, 2026. By creating an account or using a service after that date, you agree to the then-current Terms.

You must provide accurate information, keep your credentials secure, and use your account only as authorized. You are responsible for activity conducted through your account to the extent permitted by law.

If a service is available to minors, participation is subject to applicable age, parental or guardian authorization, and safeguarding requirements.

MALKOT may offer programs, registrations, waitlists, appointments, community activities and other services. Availability, capacity, schedules, eligibility, provider participation and service details may change.

A registration, waitlist position or booking is not guaranteed until the platform confirms it. Additional program- or service-specific conditions disclosed before registration or purchase also apply.

Where a service requires payment, prices, applicable fees and material payment terms will be disclosed before purchase. Payments may be processed by an external payment processor.

Cancellation, rescheduling and refund rules may vary by service and will be disclosed where applicable. Nothing in these Terms limits non-waivable consumer rights.

You may not misuse the platform, interfere with its security or operation, access another person’s account without authorization, submit unlawful or harmful content, impersonate another person, scrape or extract data without authorization, or use MALKOT to violate applicable law or the rights of others.

If MALKOT permits you to submit content, you remain responsible for that content and must have the right to provide it. You grant MALKOT a non-exclusive license to host, display, reproduce and process that content only as reasonably necessary to operate, moderate and provide the relevant service.

MALKOT may remove or restrict content or accounts that violate these Terms, applicable law, safety requirements or the rights of others.

Some services may involve independent providers or third-party services. Their separate terms may apply where disclosed. MALKOT does not control third-party websites or services and is not responsible for their independent acts or policies except where applicable law provides otherwise.

Except for user content and third-party materials, the MALKOT platform, branding, design, text, software and other materials are owned by or licensed to MALKOT and may not be copied, distributed or commercially exploited without authorization, except as permitted by law.

Personal information is handled as described in the MALKOT Privacy Policy. MALKOT is based in the United States, and personal information collected through the platform will be transferred to, processed in and stored in the United States, subject to the safeguards described in that Policy.

We may maintain, update, suspend or change features where reasonably necessary. We do not guarantee uninterrupted or error-free operation. We will provide notice of material changes where required by law.

MALKOT may suspend or terminate access where reasonably necessary for security, fraud prevention, material breach, unlawful conduct or protection of users or the platform. You may stop using the service at any time, subject to outstanding obligations and applicable retention requirements.

To the maximum extent permitted by applicable law, MALKOT provides the platform on an “as available” basis and does not make warranties that cannot reasonably be supported. MALKOT does not exclude or limit liability where doing so is prohibited by law, including liability that cannot legally be waived.

Any final limitation-of-liability, indemnification, governing-law, venue or dispute-resolution provisions require management approval before these Terms become effective.

We may update these Terms. The current version and effective date will be displayed on the site. Where required, we will provide additional notice or obtain renewed acceptance before a material change takes effect.

The MALKOT Community is a private space available to eligible MALKOT Community Members. Participation is subject to these Terms and the MALKOT Community Guidelines.

Members may post messages, comments, external links and other content made available through the Community features. Legitimate self-promotion, including links to businesses, projects, ministries, events, websites, social-media pages and other lawful activities, is permitted, subject to the Community Guidelines.

Your Content. You remain responsible for content you submit to the Community and retain any rights you hold in that content. You grant MALKOT a non-exclusive, worldwide, royalty-free license to host, store, reproduce and display your content, and to use it as reasonably necessary to operate, secure and moderate the Community. This license is limited to those purposes and does not transfer ownership of your content to MALKOT.

You must have the necessary rights or permission to post the content you submit. You may not use the Community to infringe another person's intellectual-property, privacy or other legal rights, or to distribute unlawful, fraudulent, malicious or abusive content.

External Links. Members may share links to third-party websites and services. MALKOT does not control or endorse third-party content merely because a link appears in the Community and is not responsible for the availability, security, accuracy or practices of third-party websites or services.

Moderation. MALKOT may review reported content and, where reasonably appropriate, hide or remove content, dismiss reports, restrict or suspend Community access, or take other reasonable measures to protect members, enforce these Terms or the Community Guidelines, maintain security, or comply with applicable law.

Members may report content they reasonably believe violates these Terms or the Community Guidelines. Abuse of the reporting system may itself result in appropriate action.

Content removed from normal Community visibility and related reports and moderation records may be retained in accordance with MALKOT's Privacy Policy, including the retention periods and exceptions described there.

The Community is private and access-controlled, but MALKOT cannot guarantee that another member will not copy, screenshot or share content outside the Community. Members should use appropriate judgment when deciding what information to post.

MALKOT may update the Community Guidelines from time to time. Where a material change requires renewed acceptance, continued participation may be conditioned on accepting the updated version.
